Welcome to Little Pastel Parties! Please read the terms and conditions outlined below carefully and prior to submitting a booking.
Acceptance of the Terms
The terms for the hire of the equipment are an agreement between you (“you”, “Hirer”) and Little Pastel Parties (“we”, “us”, “our”).
The Hirer accepts the terms and conditions outlined below by submitting an enquiry to Little Pastel Parties. If you do not agree with any matters, please refrain from using out services.
The terms and conditions are an agreement and acts as a legal contract between Little Pastel Parties and the Hirer.
Terms of Payment
To secure a booking with us, the Hirer must pay a minimum 50% deposit of the total hire cost. The remaining balance is due 7 days prior to the booking date.
Payments can be made to us via bank transfer, credit/debit card, PayPal, or cash.
Bond Security
The Hirer must pay a security bond of $200, due with the remaining balance of the booking 7 days prior to the booking date.
The bond is held to cover any potential damages, losses, or late returns during the rental period.
The bond will be refunded within 7 days once the equipment has been inspected for damages, neglect or misuse.
If the equipment is damaged or significantly dirty from ignoring the rules of play, the bond may not be returned in full to cover repairs, replacements and cleaning fees.
Rules of Play
The Hirer must abide by the following Rules of Play:
All shoes are strictly prohibited from the soft play area and socks must be worn.
No face paint, glitter, party poppers to be within the soft play area.
No food or drinks in the soft play area.
No sharp objects near the soft play area. Be aware of clothing and accessories with sharp items e.g.: belts, jewellery, sequins, gems.
Children must be always supervised by an adult
Children aged 0-5 years old are only allowed in the soft play area. Adults may enter for supervision and assistance but refrain from sitting on play items.
No outside toys or objects may enter the soft play area.
The equipment must not get wet or be fully exposed to the sun. The surfaces can become slippery and/or hot and a hazard to patrons.
Damage to Hire Items
The Hirer is responsible for the care of the equipment for the entire hire period.
You accept all liability for any damage or loss of equipment during your rental period, including any damage caused by other party attendees.
If damage occurs to the equipment, we will repair/replace the items at the Hirer’s expense.
Any disputes about damages or deductions from your bond will be resolved in accordance with the terms and conditions.
The Hirer will indemnify Little Pastel Parties against any claims, liabilities, costs, or expenses arising from the use or misuse of the equipment during the hire period.
Delivery/Setup/DIY
We have three options for hiring out our equipment:
Option One – Delivery/Setup/Collection:
This hire price includes delivery within a 20km radius of Ellenbrook, WA based on Google Maps calculations. Delivery outside this area will incur a delivery fee of $4 per kilometre added to your booking total.
Delivery and setup will take place 1 hour prior to the event start time and pack up commences at the conclusion of the hire period and takes approximately 1 hour.
The Hirer allows Little Pastel Parties to enter the property at the address specified on the booking form for the delivery, setup and collection of the equipment.
The Hirer is responsible for ensuring there is adequate access and space for the delivery and setup of the equipment. Extra charges will incur if we encounter restricted access or lengthy carting of equipment.
We reserve the right to cancel a booking should the Hirer fail to notify us of any obstacles that may cause the delivery and setup to be deemed unsuitable or unsafe.
Option Two – Delivery/Collection:
This hire price includes delivery within a 20km radius of Ellenbrook, WA based on Google Maps calculations. Delivery outside this area will incur a delivery fee of $4 per kilometre added to your booking total.
Delivery of the items will occur 1 hour prior to the hire period and collection is 1 hour post hire time. Other alternate arrangements can be discussed at time of booking.
The delivery/collection option does not include setting up the play area. Our equipment is on a trailer and the trailer will be delivery to the event location and locked. We will then return at the end of the hire period to collect the trailer.
If the trailer cannot be packed in the same manner that it was delivered, all items must be located next to the trailer for us to store.
Extra fees will incur if we must collect items from inside venues.
Option Three – DIY:
This hire price does not include any delivery or setup of the items.
Pickup location is Ellenbrook, WA.
Pickup and drop off times will be discussed at the time of booking to work around schedules and life commitments.
Our equipment is mostly on a trailer, apart from two ball bags that will need to fit in your vehicle.
You will need a trailer hitch to be able to tow our trailer.
A trailer plug can be supplied at pickup if required for your vehicle.
Your vehicle will need to be able to tow a trailer safely and the driver must have towing experience.
If you cannot securely repack the trailer after your event to transport back, you must have safe and secure means to transport the remaining equipment.
Extra fees will incur if we must come assist with the collection.
Cancellation and Postponements
You may cancel your booking at any time, by notifying us in writing and as soon as possible.
Cancellations made more than 14 days prior to the booking date will receive a full refund of the deposit.
Cancellations made between 7-14 days prior to the booking date will receive a 50% refund of the deposit.
Cancellations made less than 7 days prior to the booking date will forfeit the deposit.
We will attempt to accommodate your requests for postponements however it must be a date that both parties sign off on. One postponement is acceptable per booking and must be rescheduled within 12 months of the original booking date.
In the event of bad weather impacting your event, refunds will not be given. Should you wish to postpone/cancel your event due to the weather forecast, our cancellation terms listed above will be applicable.
Weather Policy
Unfortunately, the weather can be unpredictable and change your event plans. We require all equipment to be used in safe environment and therefore the below terms must be adhered to regarding weather:
In the event of adverse weather conditions (e.g.) rain, the Hirer must have a Plan B for an indoor setup if the original party was scheduled to be outdoors.
The months of June, July and August only allow indoor setups due to the Winter months unpredictability.
Temperatures ranging from 30-35 degrees must have adequate shade over the equipment for outdoor parties.
Temperatures over 35 degrees must be relocated indoors.
If your event is moved indoors, the Hirer must ensure there is adequate space and access for the equipment.
We reserve the right to cancel your hire if the weather forecast indicates unfavourable conditions such as extreme heat, rain or strong winds and you do not have an indoor Plan B solution, or it is deemed too dangerous for setup and pack up of the equipment. We will monitor the weather conditions leading up to your event date and notify you as soon as possible if any cancellations are necessary.
Little Pastel Parties will not be responsible for any weather-related disruptions or the inability to set up equipment.
Limitation of Liability
Little Pastel Parties is not liable for any injuries, accidents, or damages that occur while using our equipment.
The Hirer will indemnify Little Pastel Parties against any claims, liabilities, costs, or expenses arising from the use or misuse of the equipment during the hire period.
Media
As the Hirer, you agree to grant us permission to use and publish any photographs and videos provided by you or other parties that tag @littlepastelparties in our own social media platforms such as Facebook, Instagram and our website.
If the Hirer wishes to not have media reshared on our platforms, we must be notified prior to the booking date to accommodate this request.
Little Pastel Parties will capture media of setting up, full setups and pack up for our marketing platforms. The Hirer agrees to have us capture content for our platforms which may include images and/or videos.
Intellectual Property
All content, logos and materials on our website and social media platforms is the property of Little Pastel Parties and may not be used without permission, unless you have been tagged or been given the authority to reshare by us.
Privacy
The Hirer acknowledges that they have read our Privacy Policy on our website.
Jurisdiction
Our terms and conditions and any disputes are governed by and interpreted in accordance with the laws of Western Australia. Any legal proceedings relating to such can only be taken in courts with jurisdiction in Western Australia.
Amendments and Variations
Little Pastel Parties reserve the right to revise and/or update our terms and conditions policy without notice, however providing you with the new terms. These will take effect once provided to the Hirer.
